Clothes Off Our Back Foundation is the owner of two federally registered trademarks for Clothes Off Our Back® and is the owner of numerous domain names that incorporate its trademark. Clothes Off Our Back® conducts auctions that include celebrity clothing through its official Website, and was enraged to discover an unauthorized use of its trademark in a confusingly similar domain name registration.
Commenting on the decision to cancel the unauthorized registration, Michel Schneider of Clothes Off Our Back Foundation said, “We are concerned about the misuse of our trademark and the erosion of the goodwill and reputation that we have worked so hard to establish. We do not want our donors and potential donors to be diverted to unauthorized Websites, whereby our worthy charities would be victimized from the loss of essential donations.”
“The ‘typo-squatter’ tactics threatened to cause confusion in the minds of consumers by providing a parked domain that advertised links to non-charitable celebrity and clothing sites,” said Milord A. Keshishian, the attorney for the Foundation. “We are pleased by the registrant’s wise decision to observe the trademark and the anti-cybersquatting laws and to voluntarily cancel its unauthorized domain name registration without the need for the court’s intervention.”
